SWEEPSTAKES PERIOD: The Confetti Pride In-Store Sweepstakes (the “Sweepstakes”) starts on April 1, 2023 at 12:01 a.m. Eastern Time (“ET”) and ends on May 31, 2023 at 11:59 p.m. Pacific Time (“PT”) (“Sweepstakes Period”). The Sponsor’s computer or that of its designee is the official timekeeper for this Sweepstakes.
ELIGIBILITY: Sweepstakes is open to all legal residents of the fifty (50) United States, except where prohibited by law, and the District of Columbia, 21 years of age or older as of date of entry. Employees of Palm Bay International/Confetti (“Sponsor”), Likeable Media, retailers displaying the point of sale with sweepstakes entry QR codes, Amsive, their subsidiaries, distributors, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Participation in the Sweepstakes per account is only eligible once a day during the Sweepstakes period. If you have received a prize from Sponsor within the past six (6) months in connection with another Sponsor promotion, you are not eligible to participate in this Sweepstakes or receive a prize. Void where prohibited by law. Sweepstakes is subject to all applicable federal, state and local laws. The Sweepstakes is void outside the fifty (50) United States and the District of Columbia and where prohibited by law. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with any retail stores. You understand that you are not providing your information to any retailer.

How to Enter: To enter, scan the QR code on display which directs entrant to http://confettiwine.com/PRIDEsweeps/ (the “Entry Site”), or navigate to http://confettiwine.com/PRIDEsweeps/ in your web browser and fill out the official entry form in its entirety and submit. This is the only entry website that you can validly enter the sweepstakes by following the directions for Sweepstakes entry; (providing your name, address, telephone number, date of birth and (if applicable) your e-mail address [“Online Entry”]). ALL ONLINE ENTRIES MUST BE RECEIVED BY 11:59 PM (PST) ON May 31st, 2023. ONLY ONE (1) ONLINE ENTRY PER PERSON, HOUSEHOLD AND/OR PER E-MAIL ADDRESS WILL BE ACCEPTED. If entrant would like to enter the sweepstakes without filling out the official online entry form, the entrant may enter by mailing a sweepstakes entry form (providing your name, address, email address, telephone number, date of birth, state) to 48 Harbor Park Drive, Port Washington, NY 11050 ATTN: Confetti Brand Manager. No entry will be accepted or deemed valid if it is submitted through any other means.
The Sponsor (Confetti! Wine) prize suppliers and any and all Internet server(s) and access provider(s) and prize providers (collectively, “Promotion Entities”), and each of their respective affiliates, subsidiaries, parent corporations and advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents (collectively, “Releasees”) are not responsible for: any incorrect or inaccurate entry information; human errors; lost, misdirected or destroyed mail entries; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers, or software, including without limitation any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in the Sweepstakes; inability to access the Entry Site or any web pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site (including the Entry Site) or for any other reason whatsoever; typographical, printing or other errors; or any combination thereof. Proof of entering information at Entry Site is not considered proof of delivery or receipt. Illegible, incomplete, and duplicate entries will be disqualified. All entries become the property of the Sponsors and will not be acknowledged or returned. False, fraudulent or deceptive entries or acts shall render entrants ineligible. By entering the Sweepstakes, entrants affirm that they have read and accepted these Official Rules.
RANDOM DRAWING & PRIZE: One (1) winner will be selected at the end of the period on or around June 1st, 2023 in a random drawing from among all eligible entries received throughout the Sweepstakes Period to win a prize totaling an approximate $4,999 value. The prize includes round trip airfare for winner and a guest to San Francisco, one hotel room for the duration of the trip, transportation to and from the airport, two Pride Rainbow VIP Event Passes, participation in Confetti Wine’s official events (including the Pride parade), and a meet and greet with Alexis Michelle.
WINNER NOTIFICATION: The potential winner will be notified via text and email, and is required to respond within 24 hours of time of issuance. If the potential winner does not respond, Sponsor is unable to contact a potential winner or a potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected. Potential winner must submit w-9, driver’s license, and winner affidavit to qualify as winner. Sponsor’s decisions are final and binding on all matters relating to this Sweepstakes. If no winner can be found prior to the reasonable travel booking date of June 20th, Sponsor has the right to cancel the sweepstakes due to the timing of the prize.
PRIZE CONDITIONS: Valid only in the U.S.A. and are void where prohibited. All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winner. Winners may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. All prize details are at Sponsor’s sole discretion. Total ARV of all prizes approximately: $4,999.
GENERAL CONDITIONS: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor, which shall be final and binding in all respects relating to this Sweepstakes; (b) to release, discharge and hold harmless Sponsor, Likeable Media, Facebook, Instagram, their affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Sweepstakes or any Sweepstakes-related activity or the acceptance, possession, use or misuse of any awarded prize; and (c) to the use of his/her name, voice, performance, photo, image, entry, and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use. By participating, entrants also agree not to release any publicity or other materials on their own or through someone else regarding their participation in the Sweepstakes without the prior consent of the Sponsor, which it may withhold in its sole discretion. By participating each entrant agrees to release, discharge and hold harmless the Released Parties from any claim made for prizes lost or otherwise lost or damaged in transit. IN ADDITION, NO IMPLIED OR EXPRESS WARRANTY FOR PRIZES IS GIVEN.
MISCELLANEOUS: Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled Entries or codes, or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, photos, the announcement of the prizes, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to any person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes (or portion thereof) and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
ARBITRATION: Except where prohibited by law, as a condition of participating in this Sweepstakes, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the Commonwealth of New York, USA.
